Special Council Meeting & Public Hearing

June 16th, 2008

 

The special meeting and public hearing of the Council of the Village of Michiana was called to order at 9:00 a.m. (EDT) by President John Luce.

 

Present were Hillary Herbst, John Llewellyn, John Luce, Sheila Stein, and Patricia Carpenter.

 

The Truth in Taxation hearing was closed due to no audience in attendance.

 

Motion by J Llewellyn and seconded by S. Stein to set the 2008 millage rate at 7.5912 mils. Motion carried unanimously on roll call vote.

 

Motion by H. Herbst and seconded by J. Llewellyn to have Forest McCance’s retirement party and park dedication on August 2nd, 2008. Motion carried, 5-0.

 

The Finance Committee recommended amending the budget to accommodate the increase in health insurance cost and increase in the garbage and recycling costs established under the new contract. The amendments were: Increase the hospitalization line item to $51,000; decrease the Attorney line item on the Council budget to $5,000; eliminate the $10,000 allocated for an administrative assistant from the Office budget; increase the Garbage-Recycling line item on the Sanitation budget to $39,000; and decrease the transfer budgeted from the General Fund to the Capital Outlay account to $20,000.

 

Motion by H. Herbst and seconded by P. Carpenter to accept the amendments as proposed by the Finance Committee. All ayes, motion carried 5-0.

 

Motion by J. Llewellyn and seconded by P. Carpenter to approve the budget for fiscal year 2008-2009 as presented by the Finance Committee. Motion carried unanimously on roll call vote.

 

There was discussion regarding several FOIA requests that had been filled but not paid for, and a review of the law stipulates requiring pre-payment, but not the denial of requests based on lack of payment.

 

Motion by H. Herbst and seconded by J. Llewellyn to amend the FOIA policy and require pre-payment on all new FOIA requests with the policy to be formally adopted at the July meeting. All ayes, motion carried 5-0.

 

President Luce directed a letter to be sent on behalf of the council requesting payment for all past due FOIA invoices.

 

Motion by J. Llewellyn and seconded by S. Stein to adjourn the meeting at 9:30 a.m. EDT.
